Joshua C. Macey is an American legal scholar who is a professor of law at Yale Law School.[1] His scholarship and teaching focus on bankruptcy, environmental and energy law, public utility regulation, and the regulation of financial institutions.[1]

Education and career

Macey received a B.A. from Yale College (2012) and an M.Sc. from the London School of Economics and Political Science (2013).[1] He earned a J.D. from Yale Law School in 2017, where he served as an editor of the Yale Law Journal.[1]

After completing his graduate studies, he worked for a year as a financial analyst at Morgan Stanley before enrolling in Yale Law School.[2] After law school, he clerked for Judge J. Harvie Wilkinson III of the U.S. Court of Appeals for the Fourth Circuit.[2][1] He was a postdoctoral associate and visiting assistant professor at Cornell Law School, and later served on the faculty of the University of Chicago Law School before joining Yale Law School in 2024.[2][3][1]

At Yale, he has taught courses including Energy Law (Electricity), Public Utility Law (Energy), and Advanced State and Federal Electricity Law.[1] He has also taught Bankruptcy, Administrative Law, and Legislation.[4] Macey is a co-author of the sixth edition of the energy law casebook Energy, Economics, and the Environment.[1][4]

Scholarship

Bankruptcy and regulation

Macey's bankruptcy scholarship examines the interaction between financial distress, environmental compliance, and mass torts. He has argued that federal bankruptcy law can work at cross-purposes with federal environmental and labor mandates,[5] and also that it can provide an effective framework for coordinating and resolving mass-tort and other aggregate liabilities.[6] Justice Brett Kavanaugh cited work co-authored by Macey in his dissent in Harrington v. Purdue Pharma L.P. (2024), a case concerning nonconsensual third-party releases in Chapter 11 plans.[6][7]

Energy law and public utilities

Macey’s work on the electric grid examines grid governance, regulatory incentives that lead to inefficient transmission planning and cost allocation, and deficiencies in resource adequacy markets.[8][9][10][11] He has co-authored work on grid reliability and clean energy integration, including Grid Reliability Through Clean Energy (with Alexandra Klass, Shelley Welton, and Hannah Wiseman).[12] Macey has presented research to energy regulators and related bodies, including at a Federal Energy Regulatory Commission technical conference and meetings of the National Association of Regulatory Utility Commissioners.[4]

Awards and honors

  • Morrison Prize (three consecutive years), awarded for Zombie Energy Laws, Long Live the Federal Power Act’s Bright Line, and Clean Energy Through Grid Reliability.[1]
  • American Bankruptcy Institute, 40 Under 40 Emerging Leaders in Insolvency Practice (2023).[1]
  • Berkeley Center for Law and Business Best Paper Award (Junior Category) for “Private Profits and Public Business” (with Aneil Kovvali) (2024).[13]

Personal life

Macey is the son of the legal scholar Jonathan R. Macey.[14][15][16] He is married to Sophia Veltfort. They have one daughter.
